Article 10A
10A. For the determination of his civil rights and obligations or in any criminal charge against him a person shall be entitled to a fair trial and due process.
Original analysis
Plain-language explanation
Article 10A constitutionalises fair trial and due process in proceedings determining civil rights and obligations or a criminal charge.
Its practical content is context-specific, but ordinarily includes a fair opportunity to know and answer the case, an impartial decision-maker, a reliable record, and a reasoned process consistent with law.
Legal test
Essential ingredients
- A proceeding determining civil rights or obligations, or a criminal charge
- A person whose rights, obligations, or criminal liability are being determined
- A procedural defect serious enough to affect fairness or due process
Consequence
Legal effect
Courts and public authorities must interpret and apply procedural law consistently with the constitutional guarantee of a fair trial and due process.
Proof and process
Burden or procedural requirement
- The person alleging unfairness should identify the concrete procedural right denied and explain its effect on the determination.
- A court ordinarily considers the proceeding as a whole, the governing statute, the opportunity afforded, and any prejudice caused.
Limits
Important exceptions and qualifications
- Article 10A does not prescribe one identical procedure for every forum; the required safeguards depend on the nature and consequences of the proceeding.
- A merely technical irregularity may not establish a constitutional violation without material unfairness or prejudice.
